Uber Drivers May Be Forced to Arbitrate Disputes

A federal appeals court recently ruled that arbitration agreements between Uber and its drivers might be enforceable.  In doing so, the appellate court reversed a ruling entered last year that the arbitration agreements were unlawful, which allowed Uber drivers to bring their claims as a class action in court.  The drivers had filed a class action against Uber for violating background check laws.

The federal appeals court in California ruled that an arbitrator, and not a federal judge, is required to determine whether Uber’s arbitration agreements are enforceable. The court also reversed the lower court’s determination that Uber’s procedures for opting out of arbitration were burdensome and illusory. The appellate court found that it was immaterial that the opt-out language was buried in the agreement.
